The evil thing about the way Apple does it in the US is that they have some kind of trade commission ban imports, instead of going through the patent court, which may a.) be a tiny bit less unreasonable, and b.) deal out fines and compulsory licenses rather than banning sale outright over some tiny little menu on a phone.

It is at least possible that patents might do what they are supposed to, encourage innovation, in medical and chemical uses, because at least there the benefit of all patents to their holder is greater than the costs of litigation and such to everyone.
