Because indexOf returns a value where I don't care about the individual bits but care about the value. And ~ is an operator modifying individual bits.

Even if ~someString.indexOf(someOtherString) does what the author intends in some weird way, it should be wrapped in a method that puts a name on what that intent is and deserves some comments explaining it.
 
@nhgrif It does work, but only because indexOf always returns -1. It's still dumb. Author should have just done !== -1. You save 4 characters and induce a hell of a lot of confusion by using ~
