So this is what i'm trying to do:
I have a physical NIC with dev name eth0 with ip 192.168.1.2 and gateway 192.168.1.1 and I want to setup a VLAN with ip 192.168.1.x and same gateway as eth0.
Setting up the VLAN runs smoothly and i give the VLAN a iface name of eth0.10 and an ip of 192.168.1.69...

Fair use is a special kind of clause that gives me warm and fuzzies, I'm pretty familiar with it in the terms of US law and to me this looks like fair use. He's essentially making it so a product his friend purchased will work on that same friends machine.
In my opinion that's fair use, but it's just one giant big 'ol grey area
