If they said something like "we concede", chances are good their stock will drop to pennies in a matter of days. No investor will want to hold stock in a company that is sued for nearly half its value.

I'm not hugely into UX but I do care about usability.

I'm not exactly a creative person. Problem is that the two skillsets are mutually exclusive in practice due to the nature of the human mind.
