It seems to me that I recall you saying that your judges can exercise "common sense" or something.
They have more freedom to apply the spirit of the law, I guess, also partly because they have the memorie van toelichting to build on.
I guess it's harder to apply "common sense" without legal uncertainty if you have no memorie van toelichting and you just have to make do with the bare text.
Then maybe you'd have too much freedom as a judge.
