@pacmaninbw - Fair point. The question was originally posed because I've been advised by a client that the first sample provided is a perfectly legitimate way of writing the code. I would argue that based on the HTML5 Spec, and current trends, that it is not. Therefore, I'm looking for advice on both how the code could be improved (hence the second sample) as well as any thoughts on whether or not developers are responsible for following the spec and adhering to such guidelines. I tried Stack Overflow but the question was booted there and I really would like the input of developers for this Q. —
