12:25 AM
Doesn't sound like Republicans for sure have the votes. Asked if the moderates were on board, Whip John Cornyn said "We're working through those issues."
I can't see them not getting the votes but hey, work at it

1 hour later…
1:28 AM
@TimStone Is the vote supposed to happen tonight?

user15026
1:43 AM
I assume that today won't change anything because it never changes anything, we just get ripped raw and put on display and people go i believe you and then nothing changes.

user15026
He's probably going to get the thing even though he was a frothing angry entitled mess

@Wipqozn tomorrow morning

@Ash you talking about the hearing for Kavanaugh and Ford?

1:59 AM
> It finally just dawned on me: Brett Kavanaugh’s voice is Ted Cruz's face.

user15026
@Memor-X nods

@Yuuki … 🤔 …Yes, actually
thoughts and prayers to the thousands of junk drawers suffering lead exposure, luckily no scout has ever remembered their neckerchief slide for any event ever https://twitter.com/nbcnews/status/1045493358335070214
RIP @Unionhawk

2:17 AM
lol
We never used the official version of that

2:35 AM
@Ash well from my understanding which is only watching Sky News when they had their US correspondent talking about it, the nomination and confirmation has nothing to do with the law or justice.
assuming that the position doesn't require one to have no convictions and those who are voting want to be assholes they could still vote him in even if he was found to be guilty
some probably want to delay until it's confirmed because they probably don't want to later deal with the fallout if Kavanaugh is found guilty later on

6 hours later…
8:14 AM
@Unionhawk perhaps a more accurate you would be: "abolish the current prison system"

2 hours later…
10:43 AM
"How dare you," screamed the accused man. "How dare you say such things about me." "You've been through so much," murmured the other men. "So much." "But is it true?" asked a woman. "How dangerous," the men warned, "If we asked that, we'd have to ask all the other men that, too."

I mean,

Wait what
"The only thing I did wrong was when I killed all those people. Is that really so bad? Who hasn't killed a bunch of people?"

whom amongst us has not on occasion engaged in the act of extrajudicial murder

Exactly. I do it every day in XCOM!

12:42 PM
In addition to the ABA’s call for a pause on the Kavanaugh nomination after previously rating him unanimously well-qualified, the Jesuit-produced Catholic magazine America on Thursday went further, calling for the Kavanaugh nomination to be withdrawn after prior endorsement. —> https://twitter.com/americamag/status/1045465487986036736
Not that I think it'll matter at this point, but
Kavanaugh even cited the ABA endorsement yesterday and now they're like "Woah buddy hold on there"

12:55 PM
It's going to be 52-48
er, wait, 52-47
maybe 51-47

1:10 PM
@Unionhawk Wait who's missing?

@TimStone former senator john mccain

I thought what's his bucket was already there to replace him?

is he?

Yeah, it was a huge thing because Kyl was literally shepherding Kavanaugh through the process and now lol he gets to vote on him
As one does
It's pretty cool and totally normal that Lindsey Graham went full-on Trump personna just so the President would like him and let him assassinate foreign heads of state

I really hope that it does turn out that this election was disrupted by Russia, because that opens the door to an Annulment of everything that Trump has done

1:19 PM
lol

Although that would probably sound weird to the hundreds of international agreements the US violated

@GodEmperorDune, welp:
Brett Kavanaugh Has Become a Hero to the Incel Community https://www.thedailybeast.com/kavanaugh-has-become-a-hero-to-the-incel-community?ref=home by @willsommer

Deep in a 500-page analysis, the Trump administration made a startling assumption: The planet will warm a disastrous 7 degrees F by 2100. Ah
That's...okay

So we’ve moved on from “humans couldn’t cause climate change” to the “it’s too late to do anything about climate change” phase.

1:33 PM
@TimStone He only claimed he was a virgin, even. He's been seen with a GF by multiple fellow classmates

lol Jeff Flake is a "it was such a hard decision but of course I'm voting with my party" yes

1:49 PM
@Unionhawk ...which one is for and which one is against?

Motion to subpoena Mark Judge, supported by all Democrats on Senate judiciary committee, is defeated 10-11.
A sexual assault survivor just confronted Jeff Flake (who just announced he's voting for Kavanaugh): "Don't look away from me! Look at me and tell me that it doesn't matter what happened to me, that you will let people like that go into the highest court of the land" https://t.co/Jix2BI090B
...Damn :/

ughh, today is gonna suck

@TimStone well I think we all know where this is headed :/

Yeah, now we know when

@TimStone Congratulations on your protesting.
I mean, I doubt they had the votes to stop the vote, but still.

There's only 21 members, no Republicans were going to vote no

@Yuuki it would have been 11-10 at most
They were hoping Flake would vote against, but he didn't

2:14 PM
@Yuuki I think they only refused to vote on the when should vote vote

I have a vehement dislike of protesting via not voting.

@Yuuki Same

AFAIK though, this vote is just "should the committee vote on passing the nomination to the senate"

"I'm so unhappy about this decision that I'm going to avoid doing anything to oppose it"

2:17 PM
@SaintWacko I mean, even if the effort's futile, I feel like voting "no" is more of a protest than not voting at all.

2:38 PM
Lindsey Graham: "I know that I'm a single white male from South Carolina and I've been told I should shut up. Well, I'm not gonna shut up."
1. Buddy
2. Wait, Lindsey Graham isn't married?

You should shut up for various other reasons too tbh
south carolina isn't even on the list

@Yuuki Same here

@Nzall hasn't it been found that Russia did meddle in the election? that the probe is just trying to figure out and/or prove if the Trump Campaign was in on it

we're not going to be saved by some oh well technically he never was the real president nonsense

@Yuuki The idea of not voting instead of voting no is a protest against the process of voting, to indicate that in your opinion, the voting process is rigged and you disagree with how it was handled. Voting no has a different meaning where you effectively say "I do not think this is the right choice to make"

2:46 PM
There's not even a mechanism to roll anything back, that's all a complete fantasy.

@puzzlepiece87 there sorta is but it's not an instant undo but more a do everything again but in reverse (eg. next guy undoes everything Trump did like how Trump has been trying to undo everything Obama did)

and we, collectively, need to build to that, it's not going to just magically start happening

unless God comes down and go "hey America, you love me don't you, then stop this shit"

So a complete fantasy then :P

the norms fairy isn't going to install joe biden or whoever as president to make drone strikes and deportations still happen but quietly so that people with privilege don't have to think about it

@Nzall if i'm reading it right, all the options there require supermajorty congress and a Supreme Court who wont shoot it down which i assume if Kavanaugh gets in, who is Trump's pick, chances are it will

the right wing understands how to gain and wield power.

So a complete fantasy then :P

they do it very well

Agreed - all the stuff we've been doing for Indivisible has basically been Tea Party of the left.

2:59 PM
@puzzlepiece87 we might as well go full fantasy, give Trump a OPed ring and then wait

@TimStone The only reason I know this is because of incredibly hypocritical "lefties" on Reddit.

The supreme court as it stands now is a highly antidemocratic institution anyway

@Memor-X Hahaha there we go. But he's already RealGollumTrump, so.

3:15 PM
Some Nazi fucks pepper sprayed attendees at the @dsa_louisville meeting tonight

3:31 PM
@Unionhawk You guys really need better cops, Jesus.

@Unionhawk Gotta love the victim blaming here.
A+, demsocs.

3:44 PM
@Yuuki ?

@Unionhawk Did you not see the multitude of "you should've brought a gun" or "it's your fault for trusting the police" comments. Fair, don't trust the police, but maybe don't express that view with "it's your fault".

Oh, scrolling down. That makes sense

user15026
Is it terrible of me that I just want the vote to be done so we all know he has the asshole seat and we can try to salvage things? Like...I feel like this is fucking inevitable.

It's inevitable
Flake's yes, Collins is already rationalizing to yes. Even if Murkowski votes no, it's 50-50, Pence comes in and pushes it through.
seriously doubt M will vote no

user15026
3:57 PM
Yeah, I just wanna be done, and I am not even American. Like dragging this out feels exhausting. I can't imagine how survivors in the US feel.

In the odd event Democrats retake the Senate we'll get a whole new saga in which we contemplate impeaching a sitting Justice

Good news though, Doug Jones is voting no
@TimStone no we won't lmao

Sure we will, it's a great talking point for 2020
They won't actually do anything, but whew will we talk about it
And everyone will continue being angry as hell! Very healthy

@Ash This probably isn't possible, but if it's possible for you to mentally write it off as "already confirmed for seat", then that would be statistically a safe thing to do.

This Ted Cruz speech keeps veering toward the cliff’s edge. Calls Kavanaugh “odd,” his penchant for hiring female clerks “unusual,” notes that sexual predators rarely offend just once, chides Democrats for not asking about other accusers... all in Kav’s defense.
"If he had killed some folk and scribbled down a coded note he'd be the perfect candidate, for me, definitely Not the Zodiac Killer"
lol Grassley told him to wrap it up

user15026
4:02 PM
@puzzlepiece87 I have just been like "yep, he has it, let's process that" so far today from inside my blanket fort (because I am sick on top of it all hurray)

@TimStone It's almost as if he's neck-and-neck in a Senatorial race in Texas.
I don't know why Ted Cruz still wants to be a Senator. It's not like he does anything and he already has enough name recognition to not need national-level office to run for President.

@Ash Yeah, hopefully that works. It seems like the least bad alternative.

Ted Cruz says "frankly" he finds Kav's calendars "kind of odd" "Not many people do that."
"Doesn't he know better than to leave a paper trail of his crimes?"

Y'know, I had only a few years ago gotten over the whole "I want to live all over the place" young adult wanderlust and had decided that I would just vacation abroad a lot.
I realize now that that may have been a mistake.

2019 is gonna be lit when Kavanaugh gets wasted and starts picking on Gorsuch for being a nerd in high school and then RBG has to break it up by suplexing him over the bench

4:09 PM
Were they in school at (roughly) the same time?

Gorsuch graduated 2 years after him
NEW: Republicans on intelligence committee block release of Russia-probe interviews with @DanaRohrabacher, whom a source tells me talked about "highly concerning contacts" with Russians during 2016 campaign. https://www.thedailybeast.com/house-intel-gop-withholds-rohrabacher-and-wasserman-schultzs-russia-probe-transcripts
🙄

@TimStone So given high school, they were definitely at school at the same time.

Yeah

Actually kinda funny that Gorsuch graduated after Kavanaugh but got on the Supreme Court before him.
Kinda morbidly funny, but yeah.

@TimStone the problem(?) here is that once R.B.G. starts suplexing she's going to have to keep suplexing people forever

4:17 PM
Rumble in the Political Jungle

And while I'm ok with her finally ascending to her ultimate destiny as an immortal suplex elemental, doing it now and leaving another opening on the court seems unwise

I would advise against thinking about it

Uhh
looks out the window
Hello, entire police force

Most of them are returning to their cars now
Something brewing in Senate Judiciary committee. Dem staffers smiling. Sasse meeting with Whitehouse. Hatch and Graham look deeply upset. #StopKavanaugh

NEW: I spoke to the women who confronted Jeff Flake in that Capitol Hill elevator. w/ @NirajC https://www.nytimes.com/2018/09/28/us/politics/jeff-flake-protesters-kavanaugh.html
As you might note the vote was supposed to be six minutes ago

@TimStone Is his last name actually Flake?

Yes, lol

That's kind of perfect
At least his name is accurate

The person who was in the (parked) car all the police were around has now driven away, weird
It's worth noting that even if the Judiciary Committee votes Kavanaugh down, McConnell could still call a floor vote. Presumably he wouldn't have the votes if the committee doesn't, given the close split in the Senate, but also surprised the committee isn't voting right now so idk
Sounds like there's a lot going on behind that door Cop just came by and told us which way to evacuate if something happens, which is unusual

5:45 PM
oh shit the democrats are going to pull a whichever country's opposition party threw a tear gas grenade on the floor

Grassley returning
Lost his keys
(I don't know what he was looking for but he did that "I'm old as hell and have forgotten where on my person I placed something" dance)
GOTTA HAVE A QUORUM, folks
Jeff Flake is calling for delayed floor vote for a week for an FBI investigation.
Now he's kissing Grassley's ass
Grassley is saying he advocates for Flake's call for the investigation, but he (correctly) says he can't guarantee it because only McConnell can
FWIW I was confused, the full floor vote isn't even tentatively scheduled until Tuesday

6:01 PM
I just started typing "statute of" into Google and one of the top suggestions is "statute of limitations on sexual assault maryland". I guess it's a question on a lot of people's minds

@TimStone explains the downvotes
seems like committee vote passed on party lines

Yes, there is an "informal understanding" that Flake would (presumably) vote no if the investigation wasn't allowed
Since this is Jeff Flake McConnell could easily call that bluff

hue i saw a great relevant joke

Grassley and Cornyn both said that they supported the idea though, so we'll have to see

we'll wait fot trump to find out and get mad online

6:08 PM
If you assume that the FBI won't be able to compel Judge's testimony and won't get much more out of the parties than we already have it might be worth doing for the sake of show, to secure Flake's vote definitively
McConnell had the floor vote for Tuesday, so moving it to Friday (or the following Tuesday? idk, they said "up to one week") is like 🤷
Sen. Graham: Somebody has got to explain that to Trump, I guess that is my job.
Yeah, so I think they'll do it

@TimStone yeah, my friends elsenet are already predicting that this will turn up a bunch of stuff that's "suspicious" but nothing that's "definite" and thus end up doing nothing but covering for his confirmation, especially if they only have a week

aiui, lying to the FBI is also a more serious offense than lying to a senate committee, so the FBI investigation might actually bear more fruit

Assuming they can convince Trump not to throw a hissy fit about it
Even Graham seems happy about this, because as @ToxicFrog said it provides a lot of cover without doing a lot

@ToxicFrog thats a week more of headlines about how terrible kavanaugh is, though

Well and that's the real kicker, lol
Because Avenatti is putting his client on air this weekend?

6:11 PM
@GodEmperorDune which will make no difference, because the Republicans do not remotely care about public opinion

and a week more of not being able to do things they want to get done before the midterms
@ToxicFrog it matters for the midterms, imo

And are incapable of feeling shame

So Trump may refuse just on that basis, and blow everything up, and then who knows

trump's teflon so far has been that there are so many scandals that nothing sticks in the news cycle long enough to filter down to people who don't hyperfocus on political news

@GodEmperorDune I also remember reading somewhere that there is a case coming for the court soon about some kind of frog which right now is 4-4

6:13 PM
...some kind of frog?
looks around warily

when stuff sticks long enough in the political news cycle, it starts percolating down to non-political national news, then local news, then people actually hear about it
this is among the reasons why the "but her emails" was much worse for clinton than everything about trump

Per pool, @realDonaldTrump just said, “whatever they think is necessary” about a possible delay in a full Senate vote on Kavanaugh. But as @LindseyGrahamSC points out, “Somebody’s got to explain this to Trump,” referring to @JeffFlake’s call for an @FBI investigation.
Counterpoint though they don't have to explain it because he doesn't care, they just have to get him to order it, which he will if they tell him it'll make him look good

@TimStone yep

@ToxicFrog Read the article: it's about how to interpret the word "habitat" when it comes to an animal and the Endangered Species Act. There are a number of critically endangered species that would benefit from having more land, but right now there's a discussion of whether a habitat is just where a species lives or what it needs to live

Aah

6:17 PM
as usual, science vs private profit

Trump on Ford: “She looks like a very fine woman. Very fine woman... a very credible witness.”

now i know this isn't severus snape. but lol nonetheless

I mean probably same
I guess we agree on beer
but maybe not even

He calls them "skis" so let's hope not or I'll disown you

Oh, welp

6:19 PM
@TimStone i thought he claimed that "skis" was the nickname of a friend of his

So much for my moment of bipartisanship

@GodEmperorDune He probably did but none of us are that clueless

Apparently, in his agenda, Kavanaughty had a statement about drinking a beer through his ass

much like the devil's 3 sided shape that definitely has nothing to do with sex

or in his yearbook or whatever

6:20 PM
So now we get to see if McConnell will honour the agreement!
FUN TIMES

he won't

@Nzall tbh this is a thing that heavy alcohol users do to pass a breathalyzer

like, in his yearbook quotes, he asks "have you boofed yet?" and he insists that he's talking about flatulence. Yes, it's quit common to ask your fellow alumni whether they've farted yet

he also said that "ralphing" had nothing to do with vomiting

Lawmakers fail to pass annual intel bill after key Dem objects http://hill.cm/zOEN8sg

6:23 PM
@TimStone yeah, my boi
before 2016 i have to confess i thought schiff was a bit of a tool for being on the intelligence committee instead of like ways and means.... i have since revised that opinion

Yeah, I'm curious what the objection was over, and assume it has something to do with Nunes
MURKOWSKI tells me she spoke with Flake before he made his decision in Judiciary committee and they are in agreement. She says she supports having an FBI investigation that is “limited in scope”

@TimStone to the surprise of no one

If that's the case and if Collins was privy I suspect McConnell will allow it, complain how it's the Democrats' fault, and then everyone will use it as coverage to vote yes a week later

@TimStone if there is nothing conclusive, it probably provides enough cover for them to vote yet. But there's still plenty of time for worse stuff to come out
If more stuff comes out, or the FBI turns up something specific, it could also mean a lot more cover for Republican defectors

It could, but I doubt they'll get much more in that timeframe

6:35 PM
did the FBI ever figure out what kavanaugh's several hundred thousand in recently paid off debts were?

They talk about making the investigation "limited in scope" and I suspect it'll be tailored to do that
@GodEmperorDune Hahah don't be silly

@GodEmperorDune if that turns out to be connected to similar incidents, this could be devastating. But I doubt they'll look into it

@TimStone i have people in my TL saying they were russian payoffs but that smells too louise menschy too me

Oh, no way
I'd be much more inclined to just think the Mercers fronted him the money or something

yeah that makes much more sense

6:39 PM
Paying off other people he's sexually assaulted?

It's still pretty crazy though because no one is disputing he had tens of thousands of dollars in debt
Even if he "bought tickets for friends" or whatever nonsense excuse there was, uhhh
What kind of person puts tens of thousands of dollars on their credit card and also has the sound judgment to sit on the Court? 🤔

i've heard "gambling while blackout drunk"

@Yuuki that is the most likely version, though all possible options sound rather insane

or given how much drinks cost in DC, maybe just getting drunk

@GodEmperorDune Which is like "oh, now we're dealing with two out of control vices"?

6:42 PM
People can get into bad financial situations in all sorts of ways and that isn't automatically a judgment of character but if you were in that kind of trouble recently idk maybe taking on the caseload of the SCOTUS isn't the best idea right now

I'm not holding my breath but if the Democrats ever manage a majority in Congress, hopefully this whole debacle has laid some pretty good groundwork to impeaching Kavanaugh.

But I doubt it will happen.

Who the fuck would take up a mortgage to pay for baseball tickets for friends? I mean, I could imagine something like him wanting to appear richer than he actually is to his friends, but even then it's far fetched

We will start next week as we started this one: expecting a Rosenstein meeting and a Kavanaugh vote.

6:44 PM
> Data from a Vox analysis of a Bloomberg transcript of the hearing, via the Washington Post

launches himself into the sun

@murgatroid99 yeah i thought that was fun

That data really took quite a journey to get there

@murgatroid99 its the journalism equivalent of MVC

god dammit

6:47 PM
@GodEmperorDune huh

I think pro-Kavanaugh folks dumping on Flake are seriously underestimating how savvy a move that was. He basically neutered Ds' central talking point. If the FBI finds nothing new (as is likely), Collins, Murkowski, and Manchin are unquestionably more likely to vote yes.
lol they're attacking Flake? something something emotions
It seems very unlikely Kavanaugh will somehow end up in more danger than he's already been, so 🤷

@murgatroid99 ok, model-view-viewmodel might be more accurate. bloomberg held the data, vox adapted it for presentation, then wapo presented it

I mean, I certainly hope so regardless, but I'm not holding my breath
Manchin releases statement also endorsing Flake and Murkowski’s call for a one week delay for FBI to do probe
Ahhh Manchin

@TimStone It really provides cover both ways. If nothing new comes out of it, they can say that they did their due diligence and vote yet. And if something new is discovered they have a plausible reason to vote no.

It is the ultimate unprincipled stance

6:52 PM
@TimStone flake learned from mccain

dam

Also Bush calling the undecideds to try and whip votes, imagine being that guy

one interesting aspect is that this could draw the other accusations into this, which they have avoided to include at all cost so far

@TimStone yep, poor centrists that let him into #resistance

"I could sit here and just paint or I could go support an accused sexual predator, hmm"

6:53 PM
@TimStone george w bush? or the guy who is not the majority whip who is making calls to whip votes

who knew that the guy signing off on war crimes for fun and profit was not a good dude just because he painted now

Update: Flake joined Democrats in calling for an FBI investigation and a one week delay on Kavanaugh’s confirmation. If he is actually insisting on that, that is the opposite of cowardly. Pending further review, we hereby withdraw our preliminary description of Flake as a coward. https://twitter.com/MotherJones/status/1045742956509048832
lol almost choked on my muffin

i mean sen feinstein asked for an FBI investigation 2 weeks ago
they could've started it and had the data by now

Yep

imagine naming your magazine after an IWW cofounder and then doing this shit

@Unionhawk oh yes she was fantastic.

@puzzlepiece87 decouple productivity as a measure of self worth, imo

@GodEmperorDune What if my dream is for you to think of me as a badass lady? :P

@puzzlepiece87 sure, be a badass lady if you want, i fully support that dream

@TimStone Question, just saw this:
> Republicans said after a caucus meeting Thursday that the committee would hold votes on Friday and the full Senate would begin voting on Saturday
Does it take 2-4 days to complete a full vote?
That just caught my eye since you had been mentioning Tuesday.
It's not an important question, just wondering.

7:27 PM
It's what I saw but then I saw Saturday too, so I'm not sure about the timeline now

@puzzlepiece87 it probably takes as long as they want it to take

@TimStone Doesn't matter, it's changed now. Thanks!
