Did either of you sign a contract? If so then you are bound by the contract provided it makes sense and is reasonable. If not then you can argue all day about what the verbal contract might or might not have been. Evidence would be what the parties agreed to in emails etc. I don't think it is worth either of you pursuing a lawsuit. I suggest simply saying that the new version has exceeded your expertise and regretfully you must pass . If you break the contract (if any) then she is entitled to refuse to pay.
