00:10
Some parents are very protective ^^;

4 hours later…
03:57
Whew
Just finished my trial
That was a clean trial
I'm tentatively optimistic
ooh
I won my motion, again :)
And for the first time ever, prosecution actually won a verdict
are you prosecution?
yup
I got complimented by the judge for making a rather unique point in my argument
04:27
a unique point!
what was it? :)
Basically, I'm arguing about the American Constitution
There's the Miranda rights, basically, no person is allowed to be a witness against themselves, blah blah blah
Basically, I'm arguing that a certain carride to the police station wasn't an illegal interrogation
Now the defendant was sitting in the backseat of the police vehicle which initially seems hella sus and seems custodial bc of the power difference
ah... I remember something about that... and about whether they were going of their own accord or not
Right, something a long those lines
However, I pointed out that the text only suggests the defendant was sitting in the backseat, but nowhere does it say that the defendant was placed in the backseat
Which means that they could have been given a lift to the station
Kind of, yeah
04:31
rather than been arrested?
It's a bit complicated, but that's the general gist
Basically the argument was really strong because of the surprise factor
me - I know nothing about legal things, but my job does involve paraphrasing complicated things into layman's terms ;p
The defense would've usually expected me to concede that "yes, the defendant was sitting in the backseat", but I countered their argument with a solid and unexpected response
ah... I see ^^;
and you only conceded that they were in the vehicle, not that they had been put into the vehicle.
I expect throwing arguments into disarray is a good thing ;p
Well, the defendant was offered a ride to the station, so it was clear that the defendant was in the car voluntarily. The defense argued that the defendant sitting in the backseat was a sign of the fact that the officer was exerting more power, and thereby coercive pressure on the defendant
Sorry if that didn't make any sense -_-;
04:35
Oh right, so the dynamics of the situation
Yeah - makes sense
Exactly
Nobody expects the argument, because usually no one really reads that finely in between the lines
But I do
I'm crossing my fingers that we won the trial
So your point was that it was unclear whether they had chosen not only the car ride but also being in the back seat?
Sort of
Let's just leave it at I did well, because I'm too tired to explain the whole case right now :P
lol
no worries
I will lower my curiosity
hehe
I can share my pre-trial argument later so you can read through exactly what I was arguing
04:41
tbh - I don't want to think about work as my brain is esplode so distraction ;p
I have had very little sleep and constant meetings %.%
aww :( that's always rough
I feel like my brain is made of blancmange
i don't know what blancmange means but i can relate
04:55
I think... it is how you spell it...
It's a weirdly tasteless ... thing... that I hated as a kid... like solid tasteless custard.
> Blancmange is a sweet dessert commonly made with milk or cream and sugar thickened with rice flour, gelatin, corn starch or Irish moss, and often flavoured with almonds. It is usually set in a mould and served cold. Although traditionally white, blancmanges are frequently given alternative colours.
i have never heard of this, but i'm guessing it's kinda like flan?
'I guess..? It's like milk jelly / jello
the ones I had never really tasted like anything
it sounds kinda interesting but if it's tasteless, i imagine it would be horrible
Maybe I just had bad versions >.>:
It always tasted grainy
a friend of mine used to take me out to a mexican tapas resturant and they had peanut butter flan as a dessert there, it was really good... i kinda wanna try making this sometime but with a flavor
like strawberry blancmange or something
05:00
peanut butter is <3
i have mixed feelings on peanut butter, but in dessert it can be pretty good
When I have a cold or whatever I usually make satay instant ramen with as much extra as I can find ;p
ooooh, peanut butter ramen. i'll have to try that on mine
"satay" is pushing it... but certainly has enough chili ginger, garlic and peanut butter... and then it will depend on what I can find in the pantry ;p
i usually do beef-flavored ramen and mix in some veggies or corn :)
it's the universal "rent is due next week" dinner
05:04
yes well... >.>; If I am being good I put better ingredients in <.<
if I am sick I just go all out "kill this with fire" which seems to work.
fair :p
Today - I am like a bicycle. Two-tyred.
lmao
I wonder if Deus would let me have that one. Exhausted, sounding like a bicycle. (3, 5)
I guess it doesn't tell you how you should spell it, sadly.
i always spelled it "tired"
is it "tyre" over there?
05:13
tire out, but tyres are on cars. I am not sure anyone would use "tyred" normally, except when describing a wheel.
but even ignoring that, two/too is indistinguishable without assistance... and therefore not great in a puzzle
huh. i did not know it could be spelled "tyre." today i learned :D
it's pretty much always "tire" over here
it's one of the things we do use in AU English... which is the weird pick'n'mix of US and UK English
y'all Aussies and your pick'n'mix
here in 'Murica our language makes perfect sense /s
like how Arkansas and Kansas pronounce kansas differently for no reason
well only because Webster decided that it needed dumbing down ;p
oooooofffff
05:16
yeah my favourite example when people tell me I am pronouncing my city name incorrectly ;p
@Sciborg that was a joke! promise :)
my all-time favorite meme is still the one where it shows a language picker, and it shows "English" and "English (Simplified)." the "English" option has a British flag. the "English (Simplified)" option has an American flag.
hehehe
it took me a second to realize the absolutely amazing shots that had been fired
actually, the thing is... US English is often pickier than UK English.
part of the cleaning up was to make rules that people should follow lol
and some of them are certainly a lot more sensible
in best Yooper accent how dare y'all say that our here American English be simple-ified, we be intelligent folk!
you be intimidatin' me with your good words???
05:19
heh - I'm not sure Oz has a better rep for being "clever"... we are boozed up beach types with odd corked hats, and casual racism.
if media is anything to go by
i mean, i love my Upper Peninsula relatives deeply, but.... hoooo boy some of them are a little.... unique
we've all got daft racists in our countries
oh! unless you are in the UK - in which case, Australia is a giant prison in which the inmates took over :)
ah yes, of course :p
which is a bit harsh, knowingly speaking poorly on behalf of the people from whose unceded lands I am typing
don't worry, i know you're kidding. ....mostly
05:23
flomps in a pile of tiredfur
may i cuddle floofcat
tailhugs a borg :)
pets floofycat :D
05:43
17mins until the next chapter collage begins.
i will probably do the zzzzz in a few minutes, brain is turning to mush :p
good night <3
mine already is, but I am gonna cut and paste some wacky hijinks.
Today's my dad's bday, and we just had a HUGE feast to celebrate :D
nightnight borg borg, sleeps well, dreams nice :)
@Anonymus25-ReinstateMonica wow - sounds awesome :)
Sadly we can't go out, cuz you know
Curse you covid...
Punches self in the face
05:46
Yep - lockdown 3 has just ended for now, here. I mean, I am glad we aren't sick, I guess.
Quite tired of living in a handful of rooms ^^: Even me being a hermit.

11 hours later…
17:17
WE LOST THE TRIAL
HOW
ONE OF THE SCORER WAS SO BIASED OH MY GOD
17:37
D:
@PrinceNorthLæraðr *scorers
what were the scores?
So scorer 1 was 155(us)-159(them), scorer 2 was 155-155, scorer 4 was 150-148
Pretty close scores, right?
Scorer 3: 152-175
They gave our best witness a 5
And a 7 on "overall team performance"
18:04
Hm, I don't like the direction of the composition, as much as I like it
18:30
You lost the trial??? :o
no!!! that sucks!!
i'm sorry :(
I'm sure you did a really good job! Sometimes things just don't go your way :(
Okay so
Our two best witnesses lost points for "running down the clock"
You get scored out of 10, and 5 is pretty low
Here's the thing
AS A WITNESS YOU'RE SUPPOSED TO WASTE THE OPPOSING SIDE'S TIME DURING CROSS
THAT'S THE WHOLE POINT SMH
Unfortunately you can't control the witnesses, I guess - maybe they just weren't convincing enough or something
Uh no
Our witnesses did great
They were doing their job
They lost points because the scorer was stupid
18:42
Ah, okay
See, the three other scorers gave them really high scores (8s, 9s, and even 10s) and very positive feedback
So you feel one scorer was biased?
Totally biased
That might be worth bringing up
Like, if they obviously lowballed you, it's probably clear to the teacher
It's not just a schoolwide thing, it's school vs school
18:44
Ohh. Blah
Our teacher coach actually got so upset he emailed the person who's like the manager, but there's not much we can do
Scorers points are final
> So scorer 1 was 155(us)-159(them), scorer 2 was 155-155, scorer 4 was 150-148
Pretty close scores, right?
Scorer 3: 152-175
That sucks
I was thinking this was just an inner-school thing and some kid was being mean
But that's way worse
No, these are working attorneys
Who have a JD
And are practicing or retired
Jeez.
Even worse
The presider was also a bit sus, but she wasn't terrible
18:46
I guess it's comforting that you know you did a good job, and the team did a great job, and you were screwed by something outside your control.
Exactly
What's worse is that it just feels like you got robbed
Because
This was single elimination finals
If we won, we would've proceeded to top eight
That's bull, ughh
And we should've proceeded to top eight
At least you know you did a good job and that's what matters
Yeah
I got 9/8/9/10 on my section and VERY positive feedback :D
The first judge actually ran out of space
18:47
Yay! :D
Did you do your Lawyer Pacing and Lawyer Voice?
And dramatically point at people?
I went for a bit more of a charming vibe than a "IMMA RIP YOU APART" vibe
I think the charming vibe was more effective
I would have arrived in full "grizzled loose cannon detective" costume and roleplayed it straightfaced and banged my fists on the table when I was making a point
"YOU'RE LYING TO ME DANGIT"
The first two times I went with a super formal, IMMA RIP YOU APART VIBE and I got 8/8/8 and 9/8/8
@Sciborg Oh, you're gonna get kicked out the courtroom for doing that
"Contempt of court"
Or get objected to badgering the witness
It would have been worth it, though
dramatic point "OBSERVE EXHIBIT A"
@Sciborg No it wouldn't lol because nothing you asked would've been answered by the witness
18:50
To be fair, I learned everything I know about courtrooms from Phoenix Wright and crime shows
@Sciborg A team tried to do that last year, and they actually got yelled at by the judge
The judge is like
"THIS IS HIGHLY IMMATURE. THIS IS NOT LAW AND ORDER, THIS IS A COURTROOM"
Oooof. I wouldn't make it five minutes then
No, you wouldn't have
Which makes you more impressive :p
because you resisted the urge to Law and Order
is that a verb now
18:51
The first scorer was giving really good constructive feedback and it was like "one other technique you can employ is" and then ran out of space
I was so sad ;-;
@bobble Law-and-Order, v.: to be the most highly dramatic and over-exaggerated portrayal of an attorney that it is possible to be
@PrinceNorthLæraðr aw :p
brain presents me with Sirius's dragon advice
Law-and-Ordering is very annoying in real life
There are actually two separate objections to that
The first is "badgering", which is when you're aggressively attacking the witness, and the second is "argumentative", which is where you as the attorney literally are "arguing" with the witness
Also, you need to remember that in a real trial
You're trying to convince the jury
The jury will not like you if you yell at any witness
They kind of have to do that in the TV shows and movies though, because real cases are SUPER boring
....sigh. so i can't live out my dreams. i see how it is
That's a different county during last year's county finals for their county
18:58
i see a bunch of white people
It's Monterey County, I think that's exclusively white people
I wouldn't know though :P
Yup, it's Centr. California. Centr. California tends to have a higher white population than the rest of the state if I'm not mistaken
You guys can watch that (though, I hope y'all don't fall asleep) to get a better understanding of exactly how mock trial works
where are all the drunk lawyers yelling at each other in comedy accents
i am disappointed
You guys should at least watch the pre-trial portion (that's the beginning) to get a sense of what I do
19:04
wait you're giving us homework?
The prosecution's pre-trial attorney is REALLY good, btw. Like 10 times better than I am
He won best pre-trial attorney for prosecution from the entire STATE
Sid
Sid
I thought this was specialized Law Uni stuff
Nah
The prosecution team is just really good
And it's a way of getting high schoolers involved in more law-y stuff
19:17
now i find it hilarious that i briefly worked on a visual novel that was very unrealistic in its depiction of lawyers
it was entirely a Law and Order comedy sideshow
there was an actual, honest-to-god scene where a Pokemon card and a small cat was presented as evidence, in that order
did any of you see my hilariously long timeline answer yet?
no! did you post?
it is up
i shall go admire it
it is beautiful
