@Safdar Well... isn't that still rationalization of wartime rape? Do you see that none of the answers explicitly say it is wrong or immoral? They don't dare to!
I don't know whether I am in the minority, but I don't think we should give any kind of explicit or implicit permission (worse still if we say God gave it) for intentional sexual assault of an unwilling person. If war makes you go crazy, do not go to war!

@user21820 The fact is that this was written in 6 BCE (2600-2700 years ago) during which it seemed as though prisoners were considered fair game (I shudder stating this). For that time period, this was much restricting than what other religions advocated since they at least force you to pay the consequences. However, using this in modern society is wrong and I feel that a lot of the world view has changed to become against this. (you aren't in the minority, I hope) and to this I agree.
@user21820: the good and bad of human nature has no end. Unfortunately the good part is rather rare. I sincerely believe that most people will do all sorts of bad things if they are allowed to get away with. War crimes are almost never put onto trial.
@Safdar Yes I know the 'consequences' are more restricting than what some other religions advocated. What I am highlighting here is the clear attempt to imbue these 'permissions' with divine approval, with not one statement that it is immoral. I don't buy any claim that what is moral varies over time, but even if one makes such a claim they cannot cite these texts as if they are still valid, unless they are unwilling to face the truth that the 'permissions' are in fact unethical.
Note that Rambam (Maimonides) lived about 1000 CE, so it's not just an issue 2000+ years ago. And now SE is 2020 CE, and still people repeat the same stuff. That's the real problem here.
@user21820 Unfortunately, I think ever ancient religious text contains both "historical records" and reports of cultural norms, and "divine inspiration". The problems begin when an entire text is said to be the Word of God, when in fact, much of it is a mere record of history/norms.

That's why it's better if people just try to do what they feel is right rather than trying to find excuses in ancient texts. =)

@amWhy Of course. No targeting was intended. There are thousands of religions that are pairwise inconsistent. At most one can be completely correct. So... we either have to spend lots of effort trying to figure out which parts are correct in which documents, or we just spend our effort elsewhere. =)

@user21820 HNQ doesn't always give the best questions from a site.. All you need are 3 upvotes on answers to get it there (if there are none or one from a specific site)

@user21820 I know because I've used it to hit HNQs on ChemSE. It's relatively silent there... It seemed to encourage giving respect to the asker as well so I found nothing wrong with it,,
@user21820: I would go even further that one should have the guts to face the consequences of their actions rather than justifying their acts on basis on religious texts (or anything said by some authority). The idea of getting away with the consequences seems to give a high to a lot of people.

@ParamanandSingh I totally agree. Getting a high from getting away is totally what some people's lives revolve around!
Unfortunately I don't see an easy solution to this problem. May be we should not get in the way when someone is facing the consequences. Often out of sympathy we try to help and thereby prevent people from suffering consequences of their actions. In my personal life I have avoided any sort of this kind of sympathy.
@ParamanandSingh Yea. It's difficult to handle both justice and compassion. My approach is to be strict with consequences but be helpful after that is settled fairly. In my opinion, wrongdoers must make full restitution, but after that we should sincerely help them along the right path to minimize the temptation for them to revert back to the wrong path.
I fully agree there, but only a few try to make full restitution (sometimes it is not possible).
There are similar themes in some of Ayn Rand novels but there are a lot of distractions and it is not easy to figure out the key ideas.
