@anon Oh I decided to do it now anyway and that worked as well. If $f(x,y,z)=zx+z^3y-xy-zy-z^4$ then $D=f^{-1}((0,\infty))$. $(0,\infty)$ is open and $f$ is continuous on $\mathbb R^3$ so $D$ is open. Thanks for the help
