Kotaku too, they probably nuked they (already low) chances to work with anything Nintendo in the future.

Notice: they are the same site that back in October basically suggested to play Metroid on an emulator (advocating for piracy) and got on Nintendo blacklist (they edited the article afterward).
And now they posted content form the leaks on twitter apparently (didn't check obviously).
I guess this will be the last time they will be able to post anything related to Nintendo.

Yeah, if they didnt receive an early copy, then they probably didnt sign an NDA. So they are free to report on it

Nonsense again. They would ask you to prove that you actually bought the game and confirm with the seller that they did indeed do the mistake.

It is not about NDA. It is about posting an article that is basically claiming you pirated the game.

@SPArcheon Know nothing about the case, but I would guess there is more than leaking the game early on a lets play. The 'Delivery guy delivered this a week early' doesn't stop you from starting to post content about it. Nothing illegal about it

If you hacked into the publisher to get it then you hit the illegal part
@Fredy31 problem is that the "leak" is only partially due to copies delivered before the due date. The original leak was because someone managed to get a ROM of the game.

So, not your problem Amazon delivered you the game 10 days before the due date. Your problem if you downloaded the rom and played the game on an emulator. Considering that the Kotaku article apparently implies they did that....
Not a lawyer, again, but
- If you play a physical copy and just got it early through a connexion or a delivery fuckup, you can play/post about it and dont think they can do much.
- If you have a digital copy, then the only way to get it is Emulate a rom on the web (trouble for piracy)
But still dont think nintendo will sue people for early sharing of it; but even if you make it big, the doors of nintendo will always be closed to you
And as I said before: Suggesting to do something is not illegal. Doing the thing is illegal
So kotaku can suggest you pick it up on emulator. As long as Nintendo cant prove they did it themselves, there is not much to sue over

I suggest you re-read this from the beginning.
You are confusing TWO separate incidents.
The first one is the October 2022 Metroid incident.
In that case Kotaku basically advocated that customers should download the game rom an play it on an emulator because the emulator offered 4k.
The original article you may look out for yourself on the Web Archive.
The fact they were forced to edit the article and publish a public "we are sorry" on that page should be enough.
The recent incident with Zelda is based on a Twitter article.

I think they understand fine, yeah nintendo don't care, but they're not profiting from any kind of relationship either

@Ronan Yeah on that they were lucky it leaked, they probably have now the occasion to review it and release it on Day 1 or even earlier because they never signed an NDA
(Probably will be on day 1 beacuse throwing the review up early kinda gives them no cards to play that they didn't make the review via illegal/piracy means)
