Both are fine. To me, "don't have the time" implies a long-term situation, whereas "don't have time" could be more temporary. For example, "My life is so busy that I don't have the time to cook" versus "Tonight I'm going to a concert so I won't have time to cook."

@Araucaria The excerpt is unclear but my understanding of what it is saying is that "all" of the three groups have these powers, so even "any" is wrong. It needs to be all, not either or any.

About the "either" question, the most curious thing for me is that either (of the three powers) is used with have (instead of has).
So the example in this comment is unclear, imho (whether it should be has or have).
As for the example in the body of your post: I wouldn't be surprised if that excerpt is from a relatively old writing, or from a rather formal or restricted register (e.g. legal stuff). In other words, that type of usage is rather rare. The story on that type of construction is somewhat different (from that of the coordination usage). @DamkerngT. So part of what I think is unclear is that I'm pretty sure the original version of the sentence uses "any"... I don't believe it would ever have been written with "either"... I believe the OP is the one who put "either" in the sentence and they are asking if that's an OK construction.
