Morning.

Oh my, @TomK. was here - long time no see!

7:57 AM
@MechMK1 Good reading, regarding dogs and ducks. And whales and fish. slatestarcodex.com/2014/11/21/…

meta: I don't see why my flag on this answer was declined. An answer saying "the previous revision was wrong" and nothing else is surely not an answer, right? Anyway, it's deleted now, so it doesn't matter anymore.
(It was declined as "flags should not be used to indicate technical inaccuracies, or an altogether wrong answer")

@MechMK1 you know those aren't the only options even for genetic sex? XYY, XXY and others also exist. And understanding of broader genders is nothing new - this is not some political fad. There is just sufficient pressure/communication/understanding now to try to gain some sort of acceptance and parity
@ConorMancone this one, I have a challenge with - it can be abused by trolls so easily. I still feel that on tech sites, if the salutations etc have nothing to do with the question then they should be removed as noise - as we have always done.

@ComFreek That particular answer is under discussion on meta from the answerer himself

Q: How should major revisions of answers been dealt with?

MechMK1I recently had quite a funny case with this answer that I had written. I wrote an answer that was technically wrong. Overnight, the question hit the HNQ, and subsequently got lots of attention and upvotes. When I had returned, there were several comments, indicating that I was indeed wrong. I do...

@RoryAlsop Indeed, for such a little thing it's a large departure from how this site has always operated. Which is just my way of saying: they took a very controversial change and rolled it out in the worst way possible. This is a gigantic screw up, and I think the backlash they are getting is perfectly reasonable

1:52 PM
@ConorMancone and the backlash continues to grow. Nearly 9 years moderating on various SE sites and I'm (optimistically) going someone comes out of the woodwork and actually tries to make a positive change. So far it isn't happening
I think if they haven't at least defined a way to re-engage with the community then I'm stepping down fully

Just posted this on Law.SE - law.stackexchange.com/questions/45572/…

Really interested in the answers, also, fuck that company lmfao.

Law is not my specialty, so I won't bother putting an answer, but I have a decent guess. Normally bonuses are completely discretionary, so there's not a thing you could do about it. However, if it is in your contract, and you have official documentation showing that you fulfilled the necessary requirements as stated in your contract, then you might have a leg to stand on
Of course it's a long way from "You may actually have a legal case" to "Getting your money from this company". If you actually want to see the money, my guess would be to start by confirming that you may actually have a legal case, and then start the conversation and slowly ratchet up the pressure, aka:

Yeah, my understanding was that it is 100% down to the directors at the end of the day, also, it's been a long while since I looked at that contract and I am about 80% sure there must have been a clause which mentioned something along the lines of "while bonuses are performance based, this also includes the financial performance of the company for the year in which the bonus covers"

1. Hey guys, where's my bonus?
2. Hey guys, the contract says I'm owed a bonus
3. Hey guys, I talked with the department of labor and they say that you really do owe me that bonus
4. Hey guys, let me introduce you to my lawyer

2:25 PM
But for the sake of the question and me wanting a coherent answer, I left that last part out because as I said, I cannot remember if the contract did say that OR not.

Anonymous
Oh, as I mentioned in the post, I have/had no desire to try and get that money.

Anonymous
The company is utter shit, they can keep it - they will need it since I see them going under in the next 5-10 years anyway.

@J.J If they left themselves any wiggle room in the contract (which if they are smart, they definitely did), then you probably won't have any sort of legal standing, so your best bet is to look at it from an interpersonal perspective (that, and accept the fact that you'll never get your bonus)

Anonymous
That's my point, I think they almost certainly did leave room, I just cannot quite remember and so I wanted some advice based on the information I can remember.

Anonymous
Also, as I said, I am not wanting to get the money. I already accepted many months ago (even before I got the bonus) that I would probably not get one.

2:27 PM
Yeah, and that's good because you probably won't ever see the money. Workplace is littered with questions about "Was promised a bonus but didn't receive it" and I'm sure there are very few cases where the person actually gets their money
At least you won't have to deal with their shenanigans anymore!

Anonymous
I'm glad too, they were fucking awful.

Anonymous
I think I already know the answer to my question anyway.

Anonymous
It's this....

Anonymous
"If the contract stated the bonus was based on individual performance & individual performance alone (i.e the companies financial performance is not a factor) and you can clearly prove you met those targets defined in the performance review document then you are entitle to that bonus and have a case".

Anonymous
"If however the contract stated that it was based on your performance AND the companies financial performance for the year, unless you can prove other people got a bonus that year then you do not have a case".

2:31 PM
:D

That would be my bet!

Anonymous
Hopefully someone will reaffirm this, I'm pretty certain that's the answer.

Anonymous
Also, it would be silly for me to get lawyers involved for the bonus given it's only £700.

Yes, I genuinely got paid such a little amount that, that's what 5% of my base salary worked out to.

What in the fuck even is this question?

3:41 PM
@J.J did you get a new job now?
@RoryAlsop did you give yourself a deadline for this?

4:27 PM
@Anders As someone who hasn't been exposed to the transgender and non-binary stuff very much before and actually wants to have an informed opinion this is helpful

4:48 PM
@TomK. end of the month, I reckon

5:05 PM
@TomK. Yeah, I'm a full-time pen-tester since 2 months!

@RoryAlsop I see. I hope it works out for you, knowing that it has been quite the task you took on here. And if you don't stay here, I hope we'll meet each other in the TMHC. And btw: thank you for the introduction to that, they have treated me quite well
@J.J oh nice! Congrats! Are you happy with your new position? And are you still in the UK?

Anonymous
Thanks! Yes, very happy with the position indeed, super happy in-fact - one of the best things to ever happen to me. And yes, yes I am. (unfortunately)

6:05 PM
@AndrolGenhald Yeah, I went from being very, very confused to just my standard amount of slightly confused after reading that.
@J.J Good question at law. And what a shit employer! Hope you have better luck in the future.

7:06 PM
Thanks @Anders and yeah, they were awful. But I really love my new place.

Anonymous
SO that's fine :D

8:46 PM
@RoryAlsop If there's a group trying to move communities out, count me in. I don't foresee the current trend of increasing unfriendliness and corporate hostility abating.
