Discussion on answer by Roger V.: Do I have the right to publish a translated pre-print of an already published chapter?

@RogerV. I read the answer and directly responded. It is wrong in the U.S. The suggestions would most likely create a derivative work. I saw the linked thread, it has one answer which is not entirely wrong but isn't exactly right either. I'm a practicing lawyer that has handled copyright matters and published regarding the DMCA. This answer invites legal hazard. A lot of people do "get away" with things like this, particularly in academia, but that means no one enforced the law that time, not that it was lawful or without legal risk.
