@Oak breaking a contract though. Which is one of the significant tenants of English Common Law. The gov't won't come after you for it, but they will enforce the contract and penalties.

@CRoss but there are a lot of other questions here. For example, if the contract terms are illegal, or the way it was "signed" is shady, it might not hold. And even if the contract seems clearly broken, it's up to the court to decide that, not to us. As long as there's no law explicitly forbidding modding an xbox, we cannot claim it is outright illegal.
Copyright infringements, on the other hand, do have clear laws about them.
 
EULAs often include clauses that are not valid in some countries, I think we shouldn't blindly follow all stuff that is in there, but decide on a case-by-case basis
 
Like for example: "I bought game X but the DRM is pissing me off. Is there a crack so I don't need the disc to play?" He legally bought the game but this is still breaking the EULA, and I don't think we should promote that.

Specifically, in order to modify a console, you basically must circumvent encryption, and in doing so, you run afoul of the way US (and most European) copyright law is structured - which is to say that the circumvention of technology intended to prevent piracy or encrypt data is illegal, regardless of whether the purpose of such circumvention is legal or not.

To put it in other terms, it's akin to a law stating that being in a building is legal, but walking through the door of said building is illegal. If you get in there, it's implied that you've broken the law.

As for the iPhone thing - that was not a broad based exemption that can be applied to consoles, and it was not a court case. The Library of Congress granted a limited time (2 years) exemption from enforcement of the non-circumvention provision with two very narrow use cases: to install software on a phone that it is not possible to install without such circumvention, or to use it on another carrier.

I don't know how it is in the rest of the world, but @badp has a valid point in the States. You are allowed to talk about any form of breaking the law (except for terrorism) without being in violation of law so long as you are not guiding anyone else through breaking it.

@Mechko Fair-use has nothing to do with either the first amendment, nor the way the anti-circumvention provision is written. Again, think of it as a law that states "It is illegal to walk through this door". It's perfectly legal for you to be on the other side of that door. But you can't walk through it or go around it and climb through the window.
 
@sjohnston US democracy is not a quick fix. Throughout history there has always been some contention with the law and the supreme court has always married the law to the constitution and not the other way.
 
that's what the DMCA stipulates. Now, you can argue about whether that's a good law, but the courts have repeatedly upheld that it is in fact a constitutionally sound law, so the only way you're going to get around it is to get it repealed congressionally.

@Brant As an English language site, with it's servers and audience being primarily (though far from exclusively) in the US, it does not really behoove us to base any 'legal' decisions on Chinese or Finnish or Russian or Senegalese copyright laws (or lack therof for that matter.)

I think questions about modding for the purposes of piracy are obviously verboten, but modding itself has sufficient non-infringing benefits that we shouldn't have a blanket ban on the topic.

It's (and I know I'm sort of comparing apples to oranges here) similar to the legal argument used in the Betamax and P2P file-sharing legal battles: If the technology has sufficient non-infringing uses, it's okay.

Now you can argue that it shouldn't be illegal, and you could make an extremely strong and convincing argument. But arguing that it isn't is just burying your head in the sand.

If it's strictly a legal thing however, I think the decision should be left to StackExchange, since they're the ones who pay the lawyers. If it's a moral thing I'm all in favor of bashing it out in meta/chat.

A modded console could potentially alter the game in memory, giving you some kind of competitive advantage.

@Brant Well, there is also the moral argument that we don't want to host any discussion of content which runs afoul of the law, regardless of how we feel about the specific law in question.
 
Coming from the point of view of someone who wants to know how to identify cheaters and cope with them, it's fine.
Coming from the point of view of someone who wants to know what advantages cheating can afford them is not.
You are claiming opposite questions to be the same.

Asking how to identify something is a far cry from asking how to do it.

Because the modded console is going to have obvious advantages over the non-modded one
And thus any answer detailing those is essentially going to be saying it's a Good Thing

kazzamallaWhen taking over another civilization's city, for instance, a city that has the oracle, does it contribute +1 to your civilization's culture as a puppet? Q: Does the zombie preview screen give any clues as to which lanes the zombies will appear on?

JSBangsIn Plants vs Zombies, at the beginning of every level you're given a preview of which zombies occur in that level while you select your plants. Is the arrangement of zombies on that screen random, or does it correspond to the lanes in which the zombies are going to appear?
