12:00 PM
I'm starting to come to my senses after two days of FUD.
Come to think of it, a name change was the right thing to do, but there wasn't a genuine need to panic.

Lol yup

The issue, despite being of a legal nature, likely could have been mediated by a CM,

We don't have private chat rooms tho

@JourneymanGeek Mods can create private rooms for moderation purposes.

@Leathe if its an ip its an A name
@bwDraco nope

12:02 PM
It's not too late. The name change was probably the right call, but we can get rid of the uncertainty (regarding unchangeable names, etc.) by bringing it up to chat.

@JourneymanGeek yeah, that's what I was thinking

@JourneymanGeek Did this change?

I just had to check after I made a comment to a question

nope
we can invite people to rooms
but there's no way to pull a regular user into a 'private' room no one else can see AFAIK
Proper thing would be 1. Talk to us
2. We'd refer it to a CM
3. Let the CM handle it over email and such

A: Do the moderators/SE employees have some type of private communication channel?

OdedModerators and employees have private chat rooms (that are invite only). There are a few such private rooms around - most sites have a specific mod only chat or two, and there is also a room for mods of all sites. And of course there is email - employees have access to email addresses of mode...

I'm going to email team@stackexchange to see if they could act as a mediator of sorts.
I kinda regret this change, but I still think it was legally necessary.

12:08 PM
trademark issue? o.O

@Leathe I don't know the full story but it sounds like someone complained DragonLord's name was violating their trademark and he has to change it.

Yes, that's the case.

That's.. insane

I'm questioning whether the name change was necessary, but better safe than sorry.

I wonder if it's okay to ask who made the complaint?

12:18 PM
A relationship indeed exists and I don't want to falsely claim otherwise.
So the complaint is meritorious.
However, this could have been better handled via SE rather than off-site.
There exists a relationship between dragonlord.com and seqcon.com; operated by the same person.

I stand by my previous statement regarding the name change - still insane that you had to change it.

Done I guess

@bwDraco I can't find any relevant trademarks for "Dragonlord" at tmsearch.uspto.gov

Odd. No longer current?
Someone else did find a result at Trademarkia.

The only one DragonLord enterprises has is for the word mark "SILVER TONGUE"

12:25 PM
Probably unregistered.
Bizarre...

So,,,
someone just bullied you into it

Weird.
I'll be in touch with a CM.

(also, I'll make a laughing stock of whoever tries it with me ;))

goes off and registers Journeyman Geek as a trademark

Hah @qasdfdsaq I already beat you to it.
mwahaha

12:27 PM
Dammit
Every fucking time.

I'll probably revert some of the username changes.
I'll investigate this further, and will come to a decision within the next few days.

I'm gonna go make a user called Silver Tongue

"I refer you to the reply given in Arkell v. Pressdram (1979). Furthermore, considering the incalculable goodwill surrounding the name, and the merits of your claim being somewhat akin to the leavings of my dog after a good walk, and that your trademark covers ( ), and there's less danger of them confusing you for me, than me for you...."
@bwDraco: check where they are incorporated?
Time for a law.se question? ;p

Came from a valid email address representing the company.

Dosen't matter
question is is there a reasonable chance of someone confusing you with them?

12:32 PM

Bob
@JourneymanGeek In a commercial capacity*

I'm not mocking you
I'm mocking them.

The trademark claim may or may not be valid. It would be necessary to consult an attorney to determine what's going on.

I apologize if it came out in that way

12:35 PM
Pretty sure there's a relationship.
...and research seems to indicate there likely is a valid claim, even if borderline.

@bwDraco: Question is really, is there grounds for you needing to abandon what seems a fairly generic online identity.

§ 43 (d) is interesting. The " Cyberpiracy prevention. ".

@Bwdraco: Im a DBA what database platform do you use by chance?
btw morning @Bob

Bob
12:40 PM

@Dave Morning.

@Dave I'd want to suggest PostgreSQL.

Bob
@bwDraco Basically, considering you are not using that name for any commercial purposes and do not profit from it and did not use it in bad faith (to intentionally impersonate or seek other gain from the trademark owner)... I'd say if it ever came to civil court you'd probably have a very strong case.

bwDraco: Ah, was hoping I had some queries that I wrote that would allow you to datamine your data for particular strings to help you out. But I havent written anything that will work with pgsql

Bob
But, yea, consult an actual lawyer.
For the most part, I'd consider this bullying.

(Note also that under trademark law you are at risk of losing your trademark if you do not pursue cases of infringement to some extent -- these letters are actually somewhat common and often nothing comes of them, except they have them to point to if they're ever at risk of losing the mark.)

"The current federal status of this trademark filing is CONTINUED USE NOT FILED WITHIN GRACE PERIOD, UN-REVIVABLE"
Application number 74468210
Current trade mark status Registration cancelled

Bob
@DavidPostill Trademarks do not have to be registered
Buut that usually means they have even less of a case.

This is a brand page for the DRAGONLORD trademark by Myers, John in Encinitas, CA, 92024. (ex) prsident of DragonLord Enterprises

Bob
@DavidPostill This is all fairly pointless, since he's not using it for commercial purposes anyway :P
> Bad faith intent described under subparagraph (A) shall not be found in any case in which the court determines that the person believed and had reasonable grounds to believe that the use of the domain name was a fair use or otherwise lawful.
Note that that subsection was specifically to prevent domain squatting.

On second thought, it would seem this is more a business competitive dispute than an actual legal dispute.

12:46 PM
Sequoia Consulting is composed of John K. Myers, et al

@bwDraco between SE and them?

Between me and them.
Research indicates that the brand seems to be no longer used, but I can't really confirm it.

Bob
@bwDraco It's not, because you are not a business and you are not using it for any commercial purpose.

Using VLC video player and don't know how to resize window while keeping aspect ratio. Is this possible?

Bob
@Boris_yo Try holding shift or ctrl?

12:48 PM
I know that something like this is possible in Paint.NET graphic editor...
@Bob Doesn't work.

Bob
@Boris_yo Actually, it keeps the aspect ratio anyway.
It doesn't stretch the video.
Just fills in extra space with black.

In any case, did @bwDraco want his name back or not, the SE team should be contacted to see if they think giving the name back to him is doable without risk of actual legal action.

@Bob Indeed!

Bob
Go Video => Always Fit Window to do that.

Changing his name back isn't really an issue.

12:50 PM
@Bob There's "Scale" option. I should disable it too?

Bob
12/20.
@Boris_yo Where?

https://www.youtube.com/watch?v=KSWqx8goqSY

Not trademark related, but this is probably one of the funniest i've seen related to copyright infringement @ defcon.

Bob
@Boris_yo Odd. You have different options from me. Which version?
@Dave tl;dw :P

@Bob o.0 v1.1.11 ...

Bob
12:53 PM
@Boris_yo Old. Very old.
2.2.1 is the current version.

lol, its a story about textfiles.com where the maintainer had this crazy guy trying to go after him for stupid copyright claims.

Bob
You should update.

Its great

Does anyone have Ubuntu 14.04.3 running somewhere ?
What's the current kernel version for that

@Bob I am proponent of not fixing what works already. Especially when it comes to updating Android apps... But VLC I should update.

Bob
12:53 PM
1.1.11 was late 2011. A bit over 4 years ago.

I seem to be on 3.13.0-66-generic

Bob
In fact, it was the last 1.x version.

1.1.11 is soo 1995

@Bob They have repository for older versions?

Bob
@Boris_yo Yea, generally I avoid unnecessary updates even though I know it's a bad idea :P
But there have been significant advancements in video decoding in recent years.
Including much better hardware accelerated decoding.
And then there's new codec support.
However, new VLC did drop a couple features... e.g. playing MIDI.

12:55 PM
@Bob Any reason?

oh vlc.. I thought you were talking about kernel version
haha

@Bob Do you usually install over existing version or uninstall old and install new?

Bob
@Boris_yo Hm. Usually I try the update first.

12:57 PM
@Leathe Aha so you can install 3.19

So it would seem

Asus 1440p 144hz gsync ips is coming out

12:58 PM
165hz apparently (not that anyone would notice the difference)

lol
Someone might!

@Bob When installing do you enable Mozilla plugin and ActiveX plugin? What is usually default before VLC is installed? What application is reponsible for playing back in Mozilla and through ActiveX?

overclock it to 180Hz!

Bob
@Boris_yo Nope. No need to.

Overclock it to...
Over 9000
