we had an anesthesiologist who'd briefly worked with him testify that basically everything in the office was stuff a hospital would've had to throw out as not up to code for some reason.

Thing is, in most states, NY included, so long as an MD is doing the work, so long as nothing goes wrong, as a patient, you have no recourse. And there's no real inspection or certification or licensing regime beyond the MD itself to ensure that nothing will go wrong.

Not to mention: Trial by jury is the WORST way to decide the standard of care. If there were a binding medical review board, it would reduce the payouts to a reasonable amount.

Unfortunately, because the cost of malpractice is only about 1% of the total of medical costs . . . no financial incentive to fix the problem.

Malpractice = Doctor made bad decision that a reasonable doctor would not have made under the same set of circumstances.

Bad outcome = Doctor made bad decision because the information he had at the time pointed in the wrong direction.

Jury definition: Patient died = malpractice.

Jury definition: Patient had bad outcome unrelated to quality of medical care = malpractice.

I could keep going.

I always tell my residents: You will kill someone in your career. It doesn't mean you are a bad doctor. It means you did the wrong thing for the right reasons.

No one likes to hear that, but it's true.
