I see that it was flagged by a Spanish speaking person whose root account is SOes and reviewed by a user for another SE community. But it seems to me that the fact does not matter in this case.

As I mentioned before, in the SE model we rely on the community's wisdom and good faith. We belief that if someone flags something it really offensive. Whether it's right or not the community will decide.

If someone thinks that something went wrong that the decision was not correct, they have a chance to speak to the community and either correct how the community sees the case or their own expectations.

I would like to recommend to you to go to MSE (and cross post it on MSOes) and talk to the community about the picture.

As I see it, it does not related to the Spanish culture or the language. (Since it's a picture of the Japanese origin.)
