> Although the Justice Department argued that the lawsuit should be dismissed because it would be too much of a “distraction” for Trump while he runs the country, Messite noted that the “president himself appears to have had little reluctance to pursue personal litigation despite the supposed distractions it imposes upon his office.”
> He cited one of the president’s tweets, issued in August, in which he challenged former CIA Director John Brennan––one of his more prominent critics––to sue him.
> He also pointed out that Trump has had no qualms about going to court over issues related to the publication of tell-all books by reporter Michael Wolff and adult film actress Stormy Daniels, or his sparring with former White House strategist Steve Bannon:

such news
very surprise

> The document condemns abortion and same-sex marriage and describes how those who don’t follow biblical law should be punished.
You can't make this shit up, holy shit

it's a race to who can shout the loudest

Polls have been extended in Gwinnett County, the subject of the more egregious of voting issues in Georgia

12:20 AM
big results from North Hell

Oh wow, McGrath pulled ahead briefly in Kentucky's 6th

*is pulling

lol @Unionhawk that Brat guy is currently losing

@Wipqozn old news, at least a week old story

that said 538 made up its mind somehow

12:26 AM
That's Florida's 6th, I'm not sure about that race
It's (R) favoured to win according to NYT

oh
wrong 6
and at the same time,
> We are up to 41 percent reporting in the Kentucky 6th, and McGrath leads Barr 53 percent to 46 percent. So far, the districts we thought were going to be toss-ups have been toss-ups.

what happen
oh, KY-6 updated
and back down to 1 in 12.
and then back up to 1 in 15
these numbers are going PLACES

12:49 AM
@Unionhawk I regret to inform you that he is now up 6 points

KY-6 is almost back to even

Barr won it by like 25+ points in 2016 I think? So hopefully it stays blue but already a surprising result

1:04 AM
@badp rounding

@badp That sounds like a recount.

GOP back to 1 in 7
...1 in 5

@Wipqozn shouldn't kill those whom you don't agree with. Maybe they should have read the 10 commandment also?

@TheMattbat999 Didn't you know? You only have to follow the parts of the Bible you agree with. The rest is mere guidelines.

@TheMattbat999 they did. the 6.1 commandment is "unless they do not believe in god, or a heretic, or eat anything with garlic in it on saturdays"

1:10 AM
... 1 in 4

@Frank nope. That ain't right.
@Memor-X 6.1 ?
Also I would be dead because I like garlic with my canned raviolis.

@TheMattbat999 It's rather convenient that such aspects get left out when you're calling for the death of those you don't like.

@TheMattbat999 yeh, it's the super fine print on the bottom of the tablet

@Frank true. Slicing and dicing the Bible to fit your agenda brings up bad problems. Good overall, but individual parts can be confusing.
@Memor-X I guess God has pinkies for a reason... 😁

fuck. 1 in 3.
oh well. I think this is my cue to wake up tomorrow to two more years of red-red-red US :)

1:15 AM
@badp for what?

for GOP holding onto the house

OH
I almost forgot they were doing that today.

@badp you was getting that anyway. just the difference between Trump doing what Trump does or Trump going "MIDTERMS WERE RIGGED, FUCKING DEMS ARE FUCKING WITH ME GRAAAA!"

I got mad about issue 1 results but then I saw it was 0.3% reported

ofcause there is the possibility that just like in the election, reality just has a brain fart and we get something else

1:24 AM
Not much will change anyway....

That's the attitude that got Trump elected.

@TimStone Very well played.
@TimStone Ahahahahaha
@badp Technically it was @BradC who lied to you :D

@Frank I was just saying no matter whom is in office. Unless one party takes complete control of the government, this whole "the other side is the devil" attitude will get us no where.

@TheMattbat999 With only two parties, that's all that's possible.
One side controls, the other is opposition.

You can have opposition between the president and congress or between houses of congress which often results in a deadlock

1:32 AM
@Frank yeah... having politcal parties isn't super smart, especially only 2

@TheMattbat999 It's a fact of the system. In order to get anything done, it needs to be there.

Two parties is a consequence of specific design choices in the systems of government and the voting system

@Frank ok...

If none of the politicians were affiliated with a specific party, they'd all be independents, and there'd be more fighting than working together.

There are countries with more than two parties

1:38 AM
Yes, like Canada.

> we think our live election day forecast is definitely being too aggressive and are going to put it on a more conservative setting where it waits more for projections/calls instead of making inferences from partial vote counts.

I'm saying parties in general are needed.

I really like these square graphs 538 has, awesome way of getting the probability and outcome immediately. Good visual work.

I think the biggest reason we have two parties specifically is the spoiler effect in first-past-the-post elections. If one candidate runs, the strongest contender is basically one that opposes them on everything, to pick up all of the other votes. If a third candidate runs, they will split votes mostly with whichever of the other two they agree with the most, making it most likely that the candidate they both oppose will win.

@murgatroid99 That's exactly why you have two parties
No doubt about it

1:41 AM
We still have that system working in Canada, though; we have three major parties.

Only two have ever won the federal election though, and we split up votes within a province

@Frank Maybe the difference is how the legislature works

In the USA whichever part gets the most votes per state hust gets all that states seats, which is nuts

It works tho. I guess.

@murgatroid99 Likely. We don't have an equivalent to the electoral college.

1:43 AM
@Wipqozn That depends on what kind of election you're looking at, and what state

@Wipqozn Eh? The NDP have never won at the federal level?

There are in fact a couple of states that split some of their electoral college votes

@Frank never come in 'first' I mean
@TheMattbat999 it doesn't work at all

I think another reason we have two main parties is that there's no real meaningful sense in which parties can form "coalitions" in Congress

> Joe Donnelly (D) of Indiana is done for

1:54 AM
Looks like the gamble of being a half-assed Republican did not pay out for him

so GOP is holding onto senate, it seems

@GodEmperorDune Oh, definitely. I didn't see that going down any other way, although I am a little irked Rick Scott is ahead in Florida
He needs to retire to his true profession of crypt keeper and stop sinking the state into the sea

NYT has beto up by a little bit
only 2% reporting though

At least one bit of good news

2:03 AM
> The Results Bot is showing the first emoji of the night. Our Deluxe forecast this morning showed a 7 in 8 chance for Democrat Joe Donnelly to win re-election to the Senate and listed the race as “lean Democrat,” but ABC News is projecting that he will lose to Republican Mike Braun. This comes as a surprise to Results Bot.
shit
Way to blow a 7 in 8, Donnellose.

IT'S OFFICIAL: @jenniferwebbfl will be the first LGBTQ woman to serve in the Florida State Legislature! #RainbowWave

@GodEmperorDune it's poetic that she wins and the clerk from above lost

loooooooooooooooooooooooooooooooooooooooool

NYT called Maryland for Hogan
But also Illinois for Pritzker, which is a flip to (D)

@TimStone @Unionhawk Congrats on 6 more years of best buddy Manchin!
To celebrate, let's find a video of him shooting a gun or something
Taylor Swift's political bae goes down.
6 more years of Marsha Blackburn ugggghhh
House chances down to 55%

C'moooon Jess King

2:28 AM
@puzzlepiece87 yeah I was really rooting for the Blankenship write in campaign

Indiana called for Braun
gg Donnelly

12 or so % reporting on issue 1 but it looks bad

To be fair to Donnelly, Nate misspoke, the final Donnelly forecast was 5 of 8, not 7.

He entertained the "ending birthright" legislation, which my dude

Yup.
Better results so far with Missouri initiatives:
but all early reporting:
67% for ethics and less gerrymandering
66% for medical marijuana, and it's beating the more corrupt alternative
70% raise minimum wage to $12 though it's a prop not an amendment again so the state legislature will probably overturn again because we are a healthy democracy
> With 50 percent reporting in Colorado, Democrat Jared Polis leads 54 percent to 43 percent and should soon clinch the distinction of being the nation’s first openly gay governor.
Shit, even McCaskill apparently not winning by enough.
NYT has Hawley at 60% to win shit.
> To clarify my post: Polis will be the first openly gay man to be governor. We already have an openly bisexual governor, Kate Brown of Oregon.

I'm watching Iowa with bated breath. The Democrat running for governor is an old family friend and a former dog training client of mine. To heck with issues.

@Jolenealaska Democrats have flipped two Governorships this evening, so fingers crossed

Ok so there's a chance

Also Brat is losing again, 0.8% split
Tennessee called for Blackburn, which is not surprising but still unfortunate

@TimStone If you're interested, 538 is calling them way before whatever you're looking at.

Pssh

I had Donnelly an hour ahead of you and...
Blackburn an hour ahead also.
> You're good! But I'm better!

Max Rose flipped NY 11? Nice

3:14 AM
Arkansas voters are overwhelmingly approving a minimum wage increase to $11. (That's a big hike and the equivalent of California's $15). 69% of voters in favor of the minimum wage hike with ~a quarter of votes counted. #Midterms2018 #wages #MinimumWage

@Unionhawk Nice
Real shame Dems are going to lose two Senate seats though and not pick any up

@Unionhawk nice

Glad all the Senate does is uhhh checks notes confirm the judiciary

@TimStone given what they were defending its not surprising

Rick Scott has resting "Coming for your soul" face and I don't understand why Florida would elect him for both governor and senator

> Looks like my home state, New Mexico, is sending America’s first Native American woman to Congress. Debra Haaland, a member of the Laguna Pueblo, appears poised to win New Mexico’s 1st District race.
> There are plenty of silver linings for Democrats in Texas. Beto may have carried some House candidates over the line: Lizzie Fletcher in the 7th District and Collin Allred in the 32rd District are both currently ahead of GOP incumbents. Even Gina Ortiz Jones is running even with Republican Rep. Will Hurd in the 23rd District, which was expected to stay red. Plus, now Beto can run for president unencumbered!
We also won NY-11, the best D win of the night so far.

@puzzlepiece87 i thought there was another native american running in a diff race
somewhere more middle of the country

@GodEmperorDune You could be totally right, though I don't know who you mean.
Hopefully they win.

3:26 AM
heidi keitkamp lost

Boo to projected (R) win in PA-11

expected but still sad

I can't believe that Kobach is on track to lose though

hey @TimStone conor lamb won

Yeah, I think his new district is more (D)?
So he was pretty set to begin with

clearly it was your money that put him over the top

I was really hoping Jess King could pull off an upset! But Smucker will win with a comfortable margin

Congratulations to @SalazarSenate18 on her election to New York state senate!

@TimStone Me neither!

@TimStone ahhhhh thats the good shit

I'm submitting a proposal to form an autonomous zone at the next general

Sounds like Democrats picked up the state trifectas in Illinois and Colorado too?

@puzzlepiece87 Yeah, I didn't expect a victory. Jesus could run as a Democrat against an actual rock and lose in this state.

@TimStone yeah but a lot of people voted for the literal nazi

3:50 AM
> Election Day promises considerable drama, but don’t expect much of it to come from Delaware
lol rude NYT
But also true, though Dems did pick up an extra state senate seat here
Ugh, I can't believe we have to wait for @GodEmperorDune's state results for once :P

@TimStone hell yeah

Got to see if both of our favourite Representatives keep their seats

abc called the house for dems

I suspect Nunes will pretty comfortably but Rohrabacher idk

Projection: today is the first day in history Americans have elected more than 100 women to the U.S. House of representatives.
@TimStone i know people who campaigned against both of them

IronStache lost too, urgh

@TimStone :/

I'm curious if he would have beaten Paul Ryan though. The Republican candidate was like Ryan's hand-picked replacement but also not Paul Ryan so perhaps not blatantly a complete tool
@Jolenealaska So far so good!

Gillum has given his concession

> "I sincerely regret that I couldn't bring it home for you, but I can guarantee you this: I'm not going anywhere. We're going to fight."
Kendra Horn (D) picks up the "Likely R" seat of Oklahoma's 5th
lol and it looks like we're going to a recount for Florida's senate race

Takeaways: America is not a democracy. Issues other than Ohio 1 appear to be successful thus far. Organize in your communities and workplaces. Join a socialist, communist, Marxist, or anarchist organization today. A better world is possible, but we must fight for it.

Also Kobach is a chump
A very important takeaway

Also if you reply to me with "yeah America is a constitutional republic not a democracy duh" I will hunt you down.
This is a pvp enabled zone

@Nzall yeah that's what I said

6:20 AM
nunes officially won, russia boi is gaining but still behind for now

Oh so 9 million more people voted for Democratic senators than GOPs, resulting in...[checks notes]...the GOP gaining three seats.
ILLEGITIMATE
FAKE

6:49 AM
That comparison doesn't even make any sense
More people voted for Democratic senators than GOPs, and more Democrats won elections than Republicans this cycle
The apparent discrepancy comes from the fact that a large majority of the seats that were up for election this cycle were previously held by Democrats, and the Democrats didn't win all of those races

Golden holding on to a slim lead in Maine's 2nd, if he doesn't clear 50% we'll get to go to ranked voting, which will take some extra time/be fun. Wisconsin's gubernatorial race is well within the 1% for a recount

That tweet legitimately offends me. It is using a nonsensical statistical comparison to construct a narrative about how we are represented by Congress, and the worst part is that there are much better meaningful statistics and issues that could be brought up to make the same argument.

@TimStone Oh, uh, about that second part...
Evers cleaned up in the Milwaukee absentee ballots that hadn't been counted, according to live TMJ broadcast just now: 38,674 to 7,181 for Walker. TV was immediately muted at Walker party after that. Almost dead silent here now.

For anyone else reading, Evers is the Democrat

@TimStone goddamn
so the california propositions are a mixed bag so far
rent control failed
but some bonds and long overdue property tax reform passed
and also the daylight saving time into the sea passed, so if congress approves it we won't have time changes anymore
los angeles community bank is still way early but heavy no so far

Looks like Texas Democrats just picked up a third congressional seat, with Gina Ortiz Jones flipping Republican Will Hurd's #CD23 seat by less than 300 votes. Secretary of State says 100% precincts reporting. Some outlets had already called the race for Hurd. Potential recount
a thread of the positive things that happened tonight (from a left perspective)
People are feeling disappointed that the GOP is still in control of the Senate, that the Blue Wave supposedly didn't happen. But we had a party in power that's utterly uninterested in allowing democracy to happen. And even with dramatic voter suppression efforts:

8:31 AM
So, do we call this a win for the Democrats?

yup
this is what winning is like

8:44 AM
It's a solid win, the odds in the Senate were just heavily stacked against the Democrats. The insane thing is that even after everything Trump has done it is still close.

There's a reason america hasn't been considered a full democracy for two years in a row
Oooh the naivety. I looked up a source to verify my claim before posting it and it has this line: "“If Mr Trump is unable to reverse the trend towards increasing social polarisation, US democracy will be at greater risk of further deterioration, especially given the interplay of this trend with other, long-standing drivers of democratic decline. For example, the US scores comparatively poorly in the democracy index in the functioning of government category,” the report said."

2 hours later…
10:54 AM
@MadScientist That's what blows my mind. It certainly proves that some people are completely hopeless.
In a sane world the GOP would have lost every seat
