just because I have the right to rip my copy of a game to my hard drive does not give me an equivalent right to download a copy of the same game off the internet to save myself the trouble.
Yes, the end result is very similar, but they are very much not the same thing in legal terms.
More specifically, it's not so much your act of downloading that's problematic as it is the host of the files distribution of it that is highly, incredibly, illegal.

The only part of that entire statement that might not hold water is:

they're saying that if I put up a webpage with direct download links to the actual roms, but I'm not hosting them on my server, that I'm still liable.

If the link is intended to go to something legitimate, and the person you're linking to decides he doesn't like you and sets it up to redirect to kiddy porn - well, that's not your fault and you shouldn't be held liable.
The point is, aside from the possibly questionable technicalities re: hardware that I mentioned above, that Nintendo statement is 100% correct, and entirely justified, and I don't see why anyone would understand it to be anything else.
Now you can argue that the laws being invoked are not justified or archaic or stupid and INFORMATION WANTS TO BE FREE and so on and so forth until you're blue in the face. But that's about the way you want things to be, not about the way things are.

The next least gray legal area I can do is watch those games being played, which is why I enjoy watching TASes and link the shit out of them.

Considering that a lot of the attraction of the Steam platform is that it completely kills used-game resale.

How do you relieve annoyance at an RNG?
 
Play something skill-based. TF2 with nocrits is a good one.
 
TF2 isn't skill-based, it's wallet-based. And if it isn't, it's RNG-based.

@SteveV See, that's not true. There are definitely weapons which give you an advantage in combat. I started disliking the game when the medic update came, but I played on because it was so incredibly easy to get the weapons. Once I could no longer acquire every item in the game, I felt disadvantaged and quit.
 
I agree with you in the cases of item sets that require a hat. I feel that hats should be cosmetic.
