@MoriDoweedhYaa3qob thank you for the reference, but I still find Mori Qafih's opinion very unconvincing
(I mean about referring to הלכות למשה מסיני as דברי סופרים because they have the rules of דדרבנן, not about kiddushei kesef - Mori Qafih is very obviously right about that)

After looking at them again I don't think it's worth it, really - the main point is as I had said, that the letter that you're quoting isn't talking about a הלכה למשה מסיני at all, and it looks like the other version is more correct. I'm not really arguing: I think that you're right that the Rambam often uses דברי סופרים to mean anything that isn't explicitly written in the Torah, and you're also right that nothing that's מדברי סופרים can be a מצוה דאורייתא.
The question is whether or not they are subject to the rules of דינים דרבנן, which they might not be
 
@Matt do you have the book? i want to see the pages. what is his argument that that tashubho is wrong and that his jirso is correct
@Matt read the pages by 7acham faur. halocho lamosha misinai is da rabbonon and it is called halocho lamosha misinai only because there is no source for it in the torah. and in order to have the jews not throw away the halocho because there is no basis for the halocho, 7azal brought the halochoth to the sanhadreen in order to pass the halochoth as valid even though there are no sources for these halochoth. any halocho passed by sanhadreen is darabbonon and not daoroitho
@Matt there are examples brought down in the pagesb y 7acham faur of what are called halocho lamosha misinai yet certainly cant be from Mosha Rabbeinu 3alow ha sholom himself and clearly darabbonon

@Matt why should i accept that s z havlin is correct in his assertion to his jirso when i have 7achom faur and mori qafi7 quoting the same piece and saying the same exact thing. if i dont have the book how can i know wat he says
