I really don't understand how short selling can be legal. In any other case, if you sold something that you didn't own, even with the promise of replacing it with an equivalent item, that would be theft. I like to take it to an extreme, and use the example of short selling a long term rental car.
 
Well it's a way for rich people to ensure that they remain rich so it's okay
But yes, logically it's just absurd
 
@MBraedley AUIU, you are not so much selling stock you don't own as selling a promise to come up with the stock somehow and hand it over soon
Which is, conceptually, not that different from commissioned works -- you are not selling something you have, you're selling a promise to build something and then give it to the person you sold the promise to. It's just that rather than building something to fulfill the promise you are buying stock.
 
Especially when you consider that they're able to short more stock than actually even exists because they can often get away with not actually officially borrowing any!
 
The difference is that if you sell promises to come up with twice as much stock as actually exists, or if you sell the promises at half the price it actually costs you go get the stock in the end, you get bailed out, while if you sell artwork for half of what it costs you to make you go bankrupt.
 
@ToxicFrog No, that stock that gets sold has a new owner. Sure, they're selling a promise to the original owner, but the stock really does change ownership.

So apparently Robin Hood is now forcibly selling some of the shares bought through their platform. Nothing malicious though from what I understand: in the terms of service, they've stated they can force you to sell your shares if your trade was a margin options trade and you don't have the funds to cover the expiring buy/call of the stock.
