I'm not really down for Kinect.
It's going to turn into the Wii's motion controls, but worse. Overused, and gimmicky.
 
If it can be used correctly I think it has the potential to be cool, but honestly, i'm already a really active person. Sometimes I just want to sit down when I play games.
And by sometimes, I mean, most the time.

I remember Homebrew being brought up before and a decision to not accept any Homebrew-related answers/questions
I dislike the question in general.
You're not supposed to be able to get access to those data files and read them normally; everything being discussed there is relevant to the Wii hacking/homebrew groups.
 
I really dislike laws like the DMCA and find them personally extremly stupid and useless, but I think we should stay clear of such legal gray areas.
 
I also really dislike the links he added about Homebrew-related stuff, like downloads etc.
but really it's a legal gray area. Nintendo doesn't want you to do anything related to Homebrew, as they've made clear by removing the channel entirely in updates, but I don't think it's strictly illegal.

Yeah, yeah, it may technically be illegal, and we have to follow the laws of the jurisdiction in which the site is hosted, etc, but /EYEROLL.

Sure, the software he's linking to there only decrypts files. What about other pieces of software that I could link to in Homebrew communities which let me fool Rock Band 2 into thinking I've purchased every single song in the game?

My personal opinion is that we should not support that which is (a) illegal or (b) that which breaks the EULA. EULA is sometimes incredibly stupid and/or legally questionable, but it gives us a clear, hard line to work with.
 
@Brant That's not good enough. I won't settle for a site policy based around trusting gut instincts. We tried that with game-rec and it failed miserably.

I think we should just nuke Homebrew-involving questions completely. There are plenty of communities to discuss those sorts of things and I don't want this site to be one of them.
 
I think the overarching issue is that no matter how well intended it makes the site(s) a target for lawyers
Don't get me wrong I like some of the homebrew projects I have seen but I would hate to loose access to a site that has been legally closed until a "resolution" was reached.

Let me rephrase. Violating terms of service can always bring sanctions on the user doing the violation. That is serious business, and I really think related topics here in gaming should mention that. But as long as we do not directly encourage people to break the law - and breaking ToS is not always the same as breaking the law, as far as I know - I really do think we should judge these topics based around whether they harm other gamers.
 
I don't think Nintendo really has a big problem with it.
