@JohnDoe well as far as i could read your statements about the reasons for fighting disbelievers is wrong its the shafi'i school of jurisprudence which holds the opinion that disbelieve is the reason for fighting
I couldn't find the quote from al-Qurtobi but my answer here islam.stackexchange.com/questions/33183/… shows that the reading fo ibn Kathir is supperting it and a-Shafi'i has learnt this reading!
while the majority Hanafi, Maliki and Hanbali say disblieve is not a justification of war but it's rather something like opression etc.

@Medi1Saif I know that 1) there's another reported saying of al-Shafi'i which is in accordance with the majority opinion, 2) now this one is important and for some reason I forgot to mention it: even this difference of opinion was only within the context of hirabah, and that's very clear if you look at the justification they give that the justification of fighting is disbelief: they state that women and children are not fought because they become prisoners of war and thus "a property" of
Muslims, and this only happens after a war and after Muslims win the war.
So it is very clear from this that the justification of war being disbelief was only in the context of an already present hirabah.
